Employee Retention Tax Credit

    I'm asking about the EMPLOYEE RETENTION TAX CREDIT.
    I am getting emails daily from finance companies requesting information so they can do the paperwork.
    Have any of you applied for this credit?
    If so, were you successful in getting the funds?
    It appears that businesses affected by the COVID with substantial losses would qualify.

    Paul,
    Yes, we applied and got about $175k in funds. We had our payroll company do it. We negotiated their fee from 10% to 3%. Not sure who out there is doing this but you could check with your CPA, payroll company if you use one or one of the companies that are soliciting you. It is absolutely worth it but I would try to negotiate the fees as much as possible. I still get those same type of offers so there are lots of companies doing it so I think you might have some leverage for negotiating. 

    It does take some time for processing and getting the funds. I think ours took about 90 days, could have been longer. Not sure but it was a while.

    It is worth the trouble.

    Yes, you should apply if you have not already.  I know many businesses who have applied and received their credit of money back and it's pretty significant.  There was confusion in the past on this  credit because when it first came out you could either do PPP or this ERC credit and most chose PPP.  They changed the "rules" and you can now do both.  I know two great companies that can help with this if you need a referral of someone you can trust.   :)

    I just forwarded you the email I sent to Kelly with the contact info.  I'm almost positive you'd qualify being in the awards industry and how much that industry was impacted by shutdowns, supply chain issues, etc.  It will be well worth your time if so.  :)

    Could you forward the info to me as well.  I asked my CPA about this and he led me to believe that because I got PPP funds, I would not be eligible for the credit.  I would welcome your contacts.

    When I originally posted this discussion item, I expected to hear that it is all a hoax.  Obviously this is not the case.
    It seems to me that most awards dealers would qualify for this based on the reduction of sales in 2020.

    So after reading thru this thread I contacted my CPA about the ERC to see what he said...

    You can be qualified due to drop in sales from 2019 to either 2020 or 2021 (a 20% decline for 2021 or a 50% decline for 2020).  We were not under a government shut down/restrictions like restaurants, so that option wouldn't apply to us.

    He said that ethically and legally he could not recommend that we apply for the ERC.

    I guess that we just got luck and were able to do well enough thru the COVID challenge!

    Hi Amelia!

     I hope you all are doing good.  I've enjoyed the TikTok videos you all have put together.  :). 

    If you would like a second opinion on the ERC let me know and I'll forward my contacts info to you.  One is a former IRS agent who is now a CPA and the other specializes in ERC and all that they do.  


    Just like many accountants haven't realized that you can now do ERC even if you did PPP, I also hear the misinformation that you had to have a loss of income.  There are many ways to qualify without having a loss of income such as, did you experience any supply chain issues that affected your business.  You have to dig into the hundreds of pages of documents to find the additional qualifications beyond just the lose of income.  I know many businesses who qualified without having a loss of income.  

    I'm definitely not trying to be pushy if you are happy with what your CPA told you.  :) I just want to be sure anyone reading this thread doesn't not look into it if they didn't have a loss of income.  We are all small businesses and this money will be dispensed until it's gone so why not all of us if we legally qualify?  I'm a huge proponent of small business and want to see those who qualify get it.  You know the bigger companies are doing it because they have people who know all the loopholes putting them at an even higher advantage with hundreds of thousands of additional funds to put toward their businesses.  Small business rant over haha lol.

    Amelia is spot on. The IRS has said they will be auditing these claims for many years to weed out those that took advantage of the situation and more than stretched the rules. That is what these fly-by-night outfits are doing. They will disappear after they get paid their fees, well before IRS comes in and requires repayment. Beware and definitely consult your CPA.

    I had previously offered a comment on being careful when dealing with third parties on the ETC.

    This is just out from the IRS.

    IR-2022-183, October 19, 2022
    WASHINGTON - The Internal Revenue Service today warned employers to be wary of third parties who are advising them to claim the Employee Retention Credit (ERC) when they may not qualify. Some third parties are taking improper positions related to taxpayer eligibility for and computation of the credit.

    These third parties often charge large upfront fees or a fee that is contingent on the amount of the refund and may not inform taxpayers that wage deductions claimed on the business' federal income tax return must be reduced by the amount of the credit.

    If the business filed an income tax return deducting qualified wages before it filed an employment tax return claiming the credit, the business should file an amended income tax return to correct any overstated wage deduction.

    Business are encouraged to be cautious of advertised schemes and direct solicitations promising tax savings that are too good to be true. Taxpayers are always responsible for the information reported on their tax returns. Improperly claimin the ERC could result in taxpayers being required to repay the credit along with penalties and interest.
